A Florida man is claiming that he is too fat to go to jail.
James Olivos, 47, was convicted in a multi-million dollar mortgage fraud scheme and was sentenced to five years behind bars.
But now he is saying that he can't go because he is morbidly obese.
Of course, the judge just believes he is making excuses. Olivos was convicted in December. Since then, he has made multiple excuses as to why he has been unable to surrender to prison, including coughing up blood, pain in his feet and ADHD.
It's not uncommon for criminals to try to stall or talk their way out of paying for their crimes.
The judge in the case has ordered Olivos to produce paperwork within 48 hours confirming his "too fat for prison" excuse.
Otherwise, he could be held in contempt of court.
