El Paso cop who gave homeless man boots starring in new video

The same Texas police officer who gained national attention for giving a homeless man a pair of boots and socks in January 2013 is now getting attention for a whole different reason.

A video of a Officer Jose Flores, 40, shooting a body builder in handcuffs in El Paso, Texas, has gone viral and is receiving national scrutiny.

The shooting took place on March 8, 2013, but the video was just released this week after the El Paso Times filed an open-records request.

The video clearly shows body builder Daniel Saenz, 37, struggling with two officers as he is being dragged into the jail.

Officer Flores then pulls his gun and fires it at Saenz.

Saenz had been arrested earlier that day after acting strangely at an Albertsons grocery store. Police received a call at approximately 9 a.m. about a man who said he was feeling paranoid and was crying and asking for hugs.

He was convinced to go to a local hospital but once he got there, Saenz allegedly punched an elderly patient and then attacked an officer, who tried to use her Taser on him several times.

The body builder was then taken to jail, but he hit his head on a door while walking in. The jail refused to accept him and he was being taken back to the hospital when the struggle and shooting occurred.

After Saenz is shot, he can be seen lying face down. Officer Flores holsters his gun and gets on top of Saenz. The body builder can be seen kicking for a few seconds until he stops moving. Eventually, Saenz is turned over and Flores begins CPR until paramedics arrive.

The bullet went through Saenz's shoulder and into his heart. He died at a nearby hospital.

An attorney for Flores claimed that the shooting was accidental. The attorney says that Officer Flores' gun went off when the jail guard knocked into him. Flores had pulled his gun because he knew that the body builder had already been Tasered earlier that day to no effect.

A grand jury declined to indict Flores after an investigation of several months. It is not known if Flores is still on El Paso's police force.

Saenz was a competitive body builder and trainer known at gyms across El Paso.
