Washoe County murder conviction upheld

Las Vegas, NV (KTNV) -- Nevada Attorney General Catherine Cortez Mastro has revered a lower federal courts decision to overturn the murder conviction of Ryan Oshun Moore who was convicted in Washoe County, NV.

Moore was convicted by a jury in Aug. 1999, of first-degree murder with the use of a deadly weapon, robbery with the use of a deadly weapon, and conspiracy to commit robbery.  

The convictions stem from a criminal occurrence in Feb.1998, in which Moore and three others conspired to rob a man whom the conspirators thought was delivering drugs to an apartment.

 The man was shot and killed after he left the apartment.  In actuality, the man was a delivery man who was delivering a food order.

After unsuccessfully challenging his convictions in state court, Moore filed a federal habeas corpus petition raising multiple claims of error.

 The federal district court granted relief which would have required Moore to be tried anew.  

The Office of the Attorney General appealed and a panel of the Ninth Circuit reversed the federal district court’s grant of relief thereby negating a new trial.
