The Ninth Circuit Court of Appeals answered a request to Gov. Butch Otter over the state's lawsuit on same-sex marriage.
The 10-word ruling denies Otter's request to increase the number of judges who will hear Idaho's same-sex marraige case in September. Otter asked the court to increase the number of judges from three to 11, citing the important marraige issue.
The request by Otter comes nearly four months after the Ninth Circuit granted Otter's request to halt same-sex marriages in our state after Federal Judge Candy Dale struck down the voter-approved same-sex marriage ban.
